Welcome to FitD.rip! These Terms of Service ("Terms") govern your use of our platform that connects fashion consultants with clients seeking personalized style advice. By using FitD.rip, you agree to be bound by these Terms.

1. Acceptance of Terms & Eligibility

By accessing or using FitD.rip, you agree to these Terms and our Privacy Policy. You must be at least 18 years old to use our services. By using FitD.rip, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Platform Description

FitD.rip is a marketplace platform that:

• Connects clients with professional fashion consultants for personalized style advice
• Facilitates payment processing for consultations
• Provides AI-powered try-on visualizations
• Offers affiliate shopping recommendations through partner networks
• Takes a 20% platform fee on all consultations and tips

3. Account Registration

Account Types

FitD.rip offers two types of accounts:

• Client Accounts: For individuals seeking fashion consultation services
• Consultant Accounts: For fashion professionals providing styling services

Account Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Consultant Terms

If you register as a consultant, you additionally agree to:

Onboarding & Payment Setup

• Complete Stripe Connect Express onboarding to receive payments
• Provide accurate tax information as required by law
• Maintain valid banking information for payouts
• Acknowledge that FitD.rip retains a 20% platform fee on all earnings

Service Standards

• Provide professional, high-quality fashion consultation services
• Respond to consultation requests within 48 hours
• Deliver completed consultations within the agreed timeframe
• Maintain professional communication with clients
• Provide honest, constructive fashion advice
• Not share client photos or information outside the platform

Tax Responsibilities

You are solely responsible for determining and paying any applicable taxes on your earnings. FitD.rip will provide necessary tax documentation as required by law (e.g., 1099 forms for US consultants earning above threshold amounts).

5. Client Terms

If you use FitD.rip as a client, you agree to:

• Pay for booked consultations in advance
• Provide clear, appropriate photos and information for consultations
• Communicate respectfully with consultants
• Not request services outside the platform to avoid fees
• Understand that fashion advice is subjective and results may vary
• Not share consultant's work or recommendations without permission

6. Consultation Process

Booking & Acceptance

• Clients submit consultation requests with required materials
• Payment is authorized but held until consultation is accepted
• Consultants have 48 hours to accept or decline requests
• Unaccepted requests expire and payments are released

Delivery & Completion

• Consultants deliver advice within agreed timeframes
• Clients can request one revision if needed
• Consultations are marked complete upon delivery
• Payment is captured upon consultant acceptance

7. Payments & Fees

Platform Fee Structure

Payment Processing

• All payments are processed through Stripe
• Client cards are charged upon consultant acceptance
• Consultant payouts are transferred via Stripe Connect
• Tips are optional and processed separately
• We do not store payment card information

Authorization

By providing payment information, you authorize FitD.rip and Stripe to charge your payment method for all fees incurred. You are responsible for any fees or charges incurred by your payment provider.

8. Cancellations & Refunds

Client Cancellations

• Can cancel before consultant accepts: Full refund
• Cannot cancel after consultant accepts (payment captured)
• Disputed consultations handled case-by-case

Consultant Cancellations

• Should decline requests they cannot fulfill
• Repeated cancellations may result in account suspension
• Must communicate issues promptly to support

Refund Policy

Refunds are issued at FitD.rip's discretion for:

• Non-delivery of services
• Significant quality issues
• Technical errors
• Fraudulent activity

9. User Content & Intellectual Property

Your Content

You retain ownership of content you submit (photos, videos, text). By submitting content, you grant FitD.rip a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely for providing our services.

Consultant Work Product

Fashion advice and recommendations provided by consultants remain their intellectual property. Clients receive a personal, non-transferable license to use consultation results for personal styling purposes only.

Prohibited Content

You may not submit content that is:

• Illegal, harmful, or offensive
• Infringing on intellectual property rights
• Containing personal information of others
• Sexually explicit or inappropriate
• Misleading or fraudulent

10. Prohibited Uses

You may not:

• Harass, abuse, or harm other users
• Circumvent platform fees by conducting transactions outside FitD.rip
• Create multiple accounts to manipulate reviews or bookings
• Use automated systems or bots
• Attempt to hack or compromise platform security
• Impersonate others or misrepresent your qualifications
• Share other users' personal information
• Use the platform for any illegal purpose
• Resell or commercially exploit platform services
• Violate any applicable laws or regulations

11. AI Features & Third-Party Services

AI Try-On Features

Our AI try-on visualizations are provided for entertainment and general guidance only. We make no guarantees about accuracy or how items will actually look when worn. AI-generated images should not be the sole basis for purchase decisions.

Affiliate Links

FitD.rip may earn affiliate commissions through SkimLinks when users make purchases through recommended product links. This does not affect the price you pay. We are not responsible for third-party retailer policies, product quality, or fulfillment.

12. Disclaimers & Limitations of Liability

No Warranties

FitD.rip is provided "as is" without warranties of any kind. We do not guarantee:

• The quality or accuracy of fashion advice
• That consultants will accept your request
• Satisfaction with consultation results
• Uninterrupted or error-free service
• Accuracy of AI-generated content

Limitation of Liability

To the maximum extent permitted by law, FitD.rip shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to FitD.rip in the past 12 months.

Fashion Advice Disclaimer

Fashion advice provided through FitD.rip is subjective and for informational purposes only. Results will vary based on individual body types, personal style, and preferences. We are not responsible for purchases made based on consultant recommendations.

13. Indemnification

You agree to indemnify, defend, and hold harmless FitD.rip, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the platform
• Your content or consultation services
• Your violation of any rights of another party
• Disputes between users

14. Termination

Termination by FitD.rip

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Repeated complaints or disputes
• Extended inactivity
• Any reason at our sole discretion

Effect of Termination

Upon termination:

• Your access to the platform will be disabled
• Pending consultations may be cancelled
• Outstanding payments will be processed
• You remain liable for any obligations incurred

15. Dispute Resolution

Arbitration Agreement

Any disputes arising from these Terms or your use of FitD.rip shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except where prohibited by law.

Class Action Waiver

You agree that disputes will be resolved individually and waive your right to participate in class actions, class arbitrations, or representative actions.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and changing the "Last Updated" date. Your continued use of FitD.rip after changes take effect constitutes acceptance of the revised Terms.

17. Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and FitD.rip regarding the platform.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Assignment

You may not assign or transfer your rights under these Terms. FitD.rip may assign its rights to any successor or acquirer.

Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
